Dismissal Secured For Satellite Dish Manufacturer
Weitz Morgan successfully secured the dismissal of a major satellite dish manufacturer from a federal Fair Labor Standards Act lawsuit that had been filed against it and a local installer.
The plaintiff sued the firm’s client along with the local installer in a class action suit alleging that the plaintiffs were employees and not independent contractors and that the dish manufacturer and installer were co-employers. Damages were in excess of $1M.
Urging the dish manufacturer to take aggressive action to defend the suit, Weitz Morgan filed and prevailed on a 12(b)(6) motion to dismiss, defeating the plaintiffs’ argument that the firm’s client and the local installer were joint employers and removing the client from the lawsuit. #successstories #representativematters
