Win For Med Spa Medical Director Facing a TMB Complaint

The firm secured a dismissal of a Texas Medical Board complaint against a med spa medical director at the pre-investigation stage. The patient complainant had alleged:

 

            “That the doctor was adding and abetting the unlicensed practice of medicine by two RNs who negligently administered Dysport to the patient which caused the patient visual    impairment and disfigurement. In addition, it was alleged there was no good faith examination or evaluation, that there is no actual oversight and that the doctor had no involvement in the Clinic’s daily operations.”


After reviewing the firm’s response to the allegations against the medical director, the TMB found there was no evidence of any violation. It specifically found the doctor was in fact the medical director with a written agreement in place. The spa had good standing orders and supervision and delegation were appropriate and consistent with signed protocols. The Board further found the Ptosis was disclosed, that the spa had worked diligently post complication to help, and the patient had failed to cooperate.


This prompt, successful result underscores the need to secure competent, aggressive counsel immediately upon receiving any kind of medical or nursing board complaint.
