Foreign Military Sales Contract Type Waiver

Until December 31, 2020 (unless otherwise amended), contracting officers are not required to use firm-fixed-price contracts for foreign military sales in accordance with Defense Federal Acquisition Regulation Supplement 225.7301-1.

Grants, Cooperative Agreements, and Loans Now Part of Prohibition on Use of Certain Equipment and Services From China

The Office of Management and Budget (OMB) has issued proposed changes to its grants regulations to implement the NDAA FY 2019 prohibition on the use of covered telecom equipment and services made by certain Chinese companies. The FAR was amended in 2019 to reflect the requirement that agencies may not procure covered equipment and services. In August 2020, the FAR will further mandate that agencies not enter into or renew a contract with companies using covered equipment and services. OMB is now moving to apply the restrictions to grants and other agreements by supplementing 2 CFR 200 to prohibit grant, cooperative agreement, and loan recipients from using government funds to contract with entities that use covered equipment and services.

Organization Established To Train CMMC Auditors

DOD’s undersecretary for acquisition and sustainment recently gave statements regarding training for CMMC auditors. According to the article, an independent accreditor association, which has already been established, is engaging in the initial training of auditors and will do so through June.
