Final Rule Issued Increasing FCA Penalties

In February, the DOJ issued a final rule adjusting for inflation the monetary penalties for False Claims Act violations. The current FCA penalties are now set at a minimum of $10,957 and a maximum of $21,563 (per claim). The rule is retroactive back to November 2, 2015, meaning the penalties apply to conduct that occurred prior to the implementation of the new rule if the alleged violations took place after November 2, 2015.
